1. The Service
FadeTalk provides time-limited and permanent 1:1 chat, group rooms that a host runs for a place and a period of time (place rooms, up to 2,000 members), and AI reply suggestions. The content of the Service may change with prior notice.
2. Accounts and Age
- The Service is available only to users aged 14 or older. This applies to guests as well (Section 3).
- You are responsible for keeping your account credentials secure.
- Impersonating others, unauthorized automation (scraping, bulk sign-ups), and interfering with the Service are prohibited.
3. Guests (Links and Place Rooms)
- A person who joins a conversation link or a guest-enabled place room without registering is a guest. For the purposes of these Terms — the prohibited conduct below, the 14-or-older requirement, reporting and blocking, and the retention of safety snapshots — a guest is a user of the Service and is bound by these Terms in the same way as an account holder.
- A guest confirms they are aged 14 or older before joining, on the same basis as at sign-up.
- A link guest can report the other party and leave the conversation without creating an account. The account holder who created the link can decline, block, or destroy the link. A guest who has been declined or blocked has no further access to that link or to the conversation behind it, and a destroyed link code is never reissued.
- A place-room guest participates only in that group. Guest access is on by default for new rooms; existing rooms stay off until the host enables it. Guests can enter and read without installing the app or creating an account, subject to admission and moderation. Sending requires account conversion and phone verification if the host account region is Korea or unknown; only a confirmed non-Korean host region permits guest sending without verification. The server uses the host account region, not a visitor-supplied region or an IP-based guess. The host controls guest admission and can decline, remove or block a guest session. Announcement-only mode, slow mode and restrictions on links apply to guests. Guests may report a message and leave without an account; they cannot start private chats or become hosts or co-hosts. Creating an account does not bypass admission or a removal.
- A guest session ends when the conversation expires. It is tied to that one conversation, gives no access to anything else in the Service, and is not an account.
- Distribution of a link is controlled by the person who created it. We do not distribute it and there is no discovery or matching: anyone holding the link can open it until it expires, is filled, or is destroyed. Post it only where you are willing to be contacted, and destroy it when you are done.
- Reports made by a guest, or about a guest, are handled and retained on the same terms as any other report (Section 8 and the Privacy Policy).
4. User Content and Prohibited Conduct
- You are responsible for the content you send.
- The following are strictly prohibited — non-consensual intimate imagery and sexually explicit deepfakes; child and youth sexual exploitation material; grooming or solicitation of commercial sex; hate, harassment, or threats; spam; and infringement of others’ rights (including copyright, likeness, and personal data).
- The app provides Report and Block features. Reported content and accounts are reviewed and may be subject to measures including content removal, feature restrictions, account suspension, or termination.
5. License to Use Your Content
We use your content only to the extent needed to provide and operate the Service (transmitting and displaying messages, preserving evidence when a report is filed, and processing for AI reply suggestions and translation where AI features are turned on as described in Section 6). We claim no ownership of your content, and we do not use it beyond these purposes or provide it to third parties.
6. AI Reply Suggestions
AI suggestions are for reference only and may be inaccurate or inappropriate. You are responsible for reviewing any suggestion before sending it. A message is processed by an external AI provider for a reply suggestion or a translation only when both the person who wrote it and the person using the feature have turned on AI features — one person’s consent is not enough — and it is not used for model training. Otherwise no message is sent to an AI provider for these purposes: reply suggestions come from the Service’s built-in suggestions and translation is not provided.
Place rooms: in a place room — a group room with a host — only messages from members who have turned on AI features are screened for content that targets a person, and anything flagged goes to that host’s review queue. The same consent governs reply suggestions and translation. If you have not turned on AI features, your messages in a place room are not sent to an AI provider or screened automatically, and they reach the host’s review queue only through a report. Screening marks; it never deletes, and the host decides. The same terms apply as to every other AI purpose — nothing is used to train the provider’s models. See the Privacy Policy.
7. Message Expiry
Messages in timed rooms are deleted when they expire, and permanent preservation is not guaranteed. When a report is filed, an evidence snapshot may be retained separately for safety purposes in accordance with the Privacy Policy.
8. Account Sanctions and Appeals
- Depending on the severity of a violation, we apply measures in stages — warning → feature restriction → temporary suspension → permanent suspension — and, where possible, notify you of the reason before or after the measure.
- For grave or urgent matters, such as child and youth sexual exploitation material, we may block access immediately and notify you afterward.
- You may appeal a sanction via support@fadetalk.app, and we will review and respond within a reasonable period.
9. Disclaimer
The Service is provided “as is” to the extent permitted by applicable law. We are not liable for damage arising from content exchanged between users, the accuracy of AI suggestions, or causes beyond our reasonable control, such as force majeure or third-party service failures. This does not apply to damage caused by our willful misconduct or gross negligence, and these Terms do not unfairly restrict your statutory rights.
10. Changes to These Terms
We may change these Terms. When we do, we will announce the effective date and the reasons for the change before the effective date, on this page and via in-Service notice. If you do not agree to a change, you may stop using the Service and delete your account.
11. Termination
You may delete your account at any time. We may suspend or terminate an account for violations of these Terms in accordance with these Terms and our operating policies.
12. Governing Law and Jurisdiction
These Terms are interpreted under the laws of the Republic of Korea, and disputes are handled by the courts with jurisdiction under applicable law.
