1. The Service
FadeTalk provides time-limited and permanent 1:1 and small-group chat with AI reply suggestions. The content of the Service may change with prior notice.
2. Accounts and Age
- The Service is available only to users aged 14 or older.
- You are responsible for keeping your account credentials secure.
- Impersonating others, unauthorized automation (scraping, bulk sign-ups), and interfering with the Service are prohibited.
3. User Content and Prohibited Conduct
- You are responsible for the content you send.
- The following are strictly prohibited — non-consensual intimate imagery and sexually explicit deepfakes; child and youth sexual exploitation material; grooming or solicitation of commercial sex; hate, harassment, or threats; spam; and infringement of others’ rights (including copyright, likeness, and personal data).
- The app provides Report and Block features. Reported content and accounts are reviewed and may be subject to measures including content removal, feature restrictions, account suspension, or termination.
4. License to Use Your Content
We use your content only to the extent needed to provide and operate the Service (transmitting and displaying messages, preserving evidence when a report is filed, and processing for AI reply suggestions where you have opted in). We claim no ownership of your content, and we do not use it beyond these purposes or provide it to third parties.
5. AI Reply Suggestions
AI suggestions are for reference only and may be inaccurate or inappropriate. You are responsible for reviewing any suggestion before sending it. If you opt in to AI suggestions, the other party’s messages are processed by an external AI provider (not used for model training); if you do not opt in, only non-AI features are provided.
6. Message Expiry
Messages in timed rooms are deleted when they expire, and permanent preservation is not guaranteed. When a report is filed, an evidence snapshot may be retained separately for safety purposes in accordance with the Privacy Policy.
7. Account Sanctions and Appeals
- Depending on the severity of a violation, we apply measures in stages — warning → feature restriction → temporary suspension → permanent suspension — and, where possible, notify you of the reason before or after the measure.
- For grave or urgent matters, such as child and youth sexual exploitation material, we may block access immediately and notify you afterward.
- You may appeal a sanction via support@fadetalk.app, and we will review and respond within a reasonable period.
8. Disclaimer
The Service is provided “as is” to the extent permitted by applicable law. We are not liable for damage arising from content exchanged between users, the accuracy of AI suggestions, or causes beyond our reasonable control, such as force majeure or third-party service failures. This does not apply to damage caused by our willful misconduct or gross negligence, and these Terms do not unfairly restrict your statutory rights.
9. Changes to These Terms
We may change these Terms. When we do, we will announce the effective date and the reasons for the change before the effective date, on this page and via in-Service notice. If you do not agree to a change, you may stop using the Service and delete your account.
10. Termination
You may delete your account at any time. We may suspend or terminate an account for violations of these Terms in accordance with these Terms and our operating policies.
11. Governing Law and Jurisdiction
These Terms are interpreted under the laws of the Republic of Korea, and disputes are handled by the courts with jurisdiction under applicable law.
